The coming election is generating much commentary about how different the world may look under a Clinton or Trump administration. But a topic that is garnering too little attention is the profound impact the election will make on our Supreme Court and American constitutional law. Not that this impact is a good thing, mind you. Indeed, the fact that our fundamental law of the land will vary dramatically depending on the political party that appoints justices is a state of affairs to be deplored.
