1. The Supreme Court issues a decision before the Jan. 19 deadline, a very fast timeline for a court that typically takes months to release opinions. Though there are exceptions. The “Pentagon Papers” case, a landmark decision by the Supreme Court defending the First Amendment right of free press, was decided in just four days. 

Barry McDonald, a professor of law at Pepperdine Caruso School of Law, sees this fast-track outcome as the most likely scenario based on how quickly the Supreme Court scheduled oral arguments. “I just think they’re going to get it done. That’s how I read the tea leaves here,” he said.
