Professor Shelley Saxer Presents "Public Safety, Private Property, and Just Compensation" -- William and Mary Law School
Professor Shelley Ross Saxer participated in the panel discussion "Public Safety, Private Property, and Just Compensation" for the Brigham-Kanner Property Rights Conference at William & Mary Law School. The annual conference took place in Williamsburg, Virginia on October 23-24.
From William & Mary Law School:
Property damage resulting from police investigations and emergency responses by public officials is common, but the role of the Constitution in securing compensation for such damage remains unsettled. The Supreme Court recently declined to consider the issue in Baker v. City of McKinney, with two justices calling it a "serious question" that would "benefit from further percolation in the lower courts." This panel will consider what has been called the "necessity exception" to the just compensation guarantee and its relation to constitutional protection of property rights.
