Excerpts from "Rethinking the Debate Over Rising Disability Accommodations in Higher Education"

As Professor Jason Jarvis, Pepperdine Caruso School of Law explains "there is a pervasive perception that students from wealthy sophisticated backgrounds get accommodations and students from less-advantaged socio-economic backgrounds do not. This is the great tragedy of the explosion in accommodations—students who need accommodations are still getting left behind because they lack the means to get tested and treated.” (interview by Commission on Disability Rights staff).

What appears to be overrepresentation may therefore reflect the cumulative effects of uneven access and improved identification over time, rather than evidence that large numbers of students are improperly receiving accommodations. And despite increasing percentages of law students with accommodations, Professor Jarvis cautions us to “resist painting with too broad of a brush because students with legitimate disabilities should receive accommodations.”
