Professor Jacob D. Charles is quoted in Bloomberg Law and CNN on the law used to convict Hunter Biden on gun charges. The Bloomberg Law article, "Hunter Biden Gun Conviction Law Has Divided US Appeals Courts," considers Biden's chance at appealing his gun conviction on Second Amendment grounds since federal courts are divided on the legality of the statute he was charged with violating.  The CNN article, "How the Supreme Court Could Help Hunter Biden Appeal His Conviction," examines the Supreme Court's decision on whether authorities may ban domestic abusers from owning guns.

“The atmospherics might change some of the ways that the judges view the case, so I’m not sure exactly what the court would do,” said Jacob Charles, a law professor at Pepperdine University who has tracked federal challenges to gun statutes post-Bruen.

But Charles noted that the Supreme Court hasn’t yet acted petitions seeking its review of that case and the Fifth Circuit’s Daniels decision, ahead of the justices’ ruling in Rahimi.

“I think they’re going to get more guidance before the Third Circuit’s going to get a chance to rule anyways,” he said.

Though the case deals with different circumstances and a different provision of a federal gun law, the high court’s decision this month on whether authorities may ban domestic abusers from owning guns could signal a path forward for Biden’s anticipated appeal – or make it harder for him to overturn his conviction.

“I definitely think they’re connected,” Jacob Charles, a law professor at Pepperdine University who focuses on the Second Amendment, said of the pending Supreme Court case and possible Biden appeal. “One possible outcome is that the court limits the gun prohibitions to people who are found to be dangerous in some way.”
