Professor Helen Winter Presents "Between Decision and Agreement: The Arbitrator, the Mediator, and Emotions in the Field of Conflict" -- International Mediation Competition Brazil

Professor Helen Winter had the privilege of speaking virtually on "Between Decision and Agreement: The Arbitrator, the Mediator, and Emotions in the Field of Conflict" for the opening event of the 2025 International Institute for Conflict Prevention and Resolution International Mediation Competition, which took place in Brazil on April 1. Representing the Pepperdine Caruso Law Straus Institute, she shared insights on the role of emotions in mediation and introduced her psychosocial peer mediation model, which empowers individuals, especially in vulnerable communities, to resolve conflicts constructively.

Alongside esteemed colleagues Rafael Alves, Diego Faleck, and moderated by Giulia Spalletta the discussion explored the psychological, legal, and cultural dynamics that distinguish mediation from arbitration. The conversation highlighted how mediators facilitate understanding and self-determination, while arbitrators deliver enforceable decisions - each playing a crucial role in today’s evolving ADR landscape.
