Abstract

This Note will explore the legislative and common law history of the education of disabled students leading up to the decision in Garret F., the Supreme Court decision itself, and possible legal effects the decision may have in the future. Part II of this Note discusses the legislative history and case law interpreting the Individuals with Disabilities Education Act. Part III presents the facts and procedural history of Garret F., while Part IV analyzes the majority and dissenting opinions of the case. Next, Part V discusses the possible impacts of Garret F. on the IDEA, the congressional use of the spending power, and the schools themselves. Finally, Part VI concludes the Note.
