Straus Institute Presents Fulbright Scholar Presentations on ADR

The Straus Institute for Dispute Resolution at Pepperdine Caruso School of Law recently hosted a series of presentations by three distinguished Fulbright Scholars, showcasing their research on mediation and alternative dispute resolution (ADR) in their respective countries. The event highlighted the global reach and impact of the Straus Institute's programs, as well as the diverse perspectives brought by international scholars.

Gladys Gondwe - Rethinking Mediation in Malawi

Gladys Gondwe Judge, of the High Court of Malawi presented her research on the state of mediation in Malawi, a common law jurisdiction. She highlighted that while Malawi has implemented mediation through Rule 13 of the High Court Civil Procedure Rules of 2017, achieving about a 50% settlement rate, significant challenges remain.

To address these challenges, Gondwe proposed conducting a comprehensive study, benchmarking Malawi's practices against comparable jurisdictions such as Uganda and Kenya. She emphasized the need for engaging key stakeholders, including the judiciary, legislature, and executive branches, to drive necessary reforms1.

Viorel Rabei - ADR and Mediation in Moldova

Viorel Rabei, Adviser to the Prime Minister’s Office in Moldova presentation focused on the development of ADR and mediation in the Republic of Moldova. He outlined strategic approaches for integrating these practices into Moldova's educational system and broader society3.

Rabei also stressed the importance of supportive policy frameworks, legal reforms, and public awareness campaigns to promote the adoption of ADR and mediation in Moldova3.

Cung (Christine) Ngaih Lun - Mediation in Myanmar

Cung Ngaih Lun, presenting on mediation in Myanmar, focused on the potential of mediation as a tool for legal reforms and transitional justice in the country. Lun focused on the current state of mediation practices in Myanmar, the challenges and opportunities for expanding mediation use, and the role of mediation in addressing conflicts in a diverse society (Myanmar has 135 ethnic groups and multiple religions). Her overall presentation was strategies for promoting conceptual development of existing mediation processes.

These presentations by Fulbright Scholars at the Straus Institute demonstrate the global relevance of ADR and mediation in addressing complex societal challenges. They highlight the importance of tailoring dispute resolution approaches to specific cultural and legal contexts while drawing on international best practices.
