Judicial Review and the Exclusionary Rule

Morgan Cloud

Abstract

My focus in this Article is not to parse the data produced by the Pepperdine Study to support its authors' arguments for an administrative tribunal to resolve most search and seizure disputes. Instead, I will examine the justifications offered by the Supreme Court in its seminal opinions defining and implementing the exclusionary principle. Ultimately, this discussion calls into question the underlying premise upon which the Supreme Court's recent decisions rest.
