Along the Borderline

Alternative Dispute Resolution (ADR) processes address a variety of client needs. In different situations, different approaches best meet the needs of particular clients. As ADR practitioners skilled at delivering a variety of processes, the question of when it is appropriate to mix approaches arises.

Is it appropriate for a mediator to take on the role of arbitrator, or for an arbitrator to mediate? What conflicts of interest can cause problems? How and when is it appropriate to shift from one process to another?

This teaching video, inspired by the work of Straus Director Thomas Stipanowich, raises these questions in arbitration and mediation re-enactments.
